Inspectors wrote, June 26, 2026, scope and severity EBased on the review of the Facility's Arbitration agreement, CMS SOM Appendix PP, and staff interview, it was determined the facility failed to ensure the facility's arbitration agreement provided the selection of a venue that is convenient to both parties. This was true for all residents who reside in the facility who signed an Arbitration Agreement. This failure created the potential for residents to be inconvenienced or the inability to participate during the arbitration process.

Inspectors wrote, June 12, 2026, scope and severity DBased on review of the facility's arbitration agreement and staff interview, it was determined that the facility failed to ensure a neutral and fair arbitration process by ensuring both the resident and/or resident representative and facility agree on the selection of an arbitrator and venue.

Inspectors wrote, June 1, 2026, scope and severity FBased on record review and interview, the facility did not ensure the Binding Arbitration Agreement provides for the selection of a neutral arbitrator agreed upon by both parties and the agreement provides for the selection of a venue that is convenient to both parties. This was evident in three (3) (Residents #17, #57, and #117) of 28 total sampled residents. Specifically, the Binding Arbitration Agreement signed by Residents #17, #57, and #117 had no documented evidence the agreement addresses the selection of a neutral arbitrator agreed upon by both parties and the selection of a venue that is convenient to both parties.
